Accelerated Rehabilitative Disposition (ARD)

Do you qualify for the ARD program?

The Accelerated Rehabilitative Disposition program, otherwise known as ARD is reserved for minor offenses and first time offenses. After they have been reviewed by the District Attorney's Office, these cases can get placed in an ARD program. In order to be placed in an ARD program, the defendant needs to agree to a probationary sentence, of which conditions will be imposed such as:

• Community service
• Drug and alcohol counseling
• Restitution to the victim

If the sentence is completed by the defendant, the arrest may be expunged from his or her record; however, if the defendant does not complete it, his or her case will instead go to trial.

The District Attorney's Office will not accept an ADR application if the DUI offense if:

• An accident occurred in connection to the DUI offense and an individual other than the defendant suffered serious bodily injury or was killed as a result of the accident.
• There was a child passenger under the age of 14 in the motor vehicle that the defendant was operating.
• The offender was on probation, parole or ARD when they committed the offense.

While on an ARD program, defendants are placed under supervision. The court may impose costs and assessments, but not a fine. Approximately 90% of people on an ARD program have been arrested for driving under the influence of drugs or alcohol. The maximum period of supervision for an ARD program is two years.
